This document and the patient relationship are governed by Chilean law and subject to the jurisdiction of the Chilean courts.
1. Why this document exists
When you receive care at Zenclinic, you give us information about your health. That information is yours, not ours. This document explains what data we process, for what purposes, with whom we share it, how long we keep it, and what you may require from us at any time.
Health data is sensitive personal data, and the law grants it reinforced protection. We are governed by Law No. 19,628, as amended by Law No. 21,719 on the Protection of Personal Data, and by Law No. 20,584, which regulates the confidentiality of the clinical record.
Law No. 21,719 comes into full force on December 1, 2026. Until that date, Zenclinic voluntarily recognizes the rights and guarantees described in this policy, to the extent compatible with the legislation currently in force. From that date, they apply with the scope established by the law and its regulations.

5. Where we obtain your data
Directly from you: when booking your appointment, completing the health declaration, during clinical care, and in your communications with us.
From your legal representative, if you are a minor or require support to make decisions.
From other health professionals or institutions, when you refer yourself to us or authorize us to request your records.
6. Whom we share your data with
To provide you with care, we need to share part of your information with third parties. Each of them accesses only the strictly necessary data, is contractually bound to confidentiality and information security, and may not use your data for its own purposes.
Providers acting on behalf of Zenclinic (processors):
- Dentalink (HealthAtom), clinical record and electronic scheduling system. Stores your record, history, and schedule, under the ISO 27001 security standard (see Section 13).
- Dental laboratories. Receive the data needed to manufacture your crowns, veneers, prostheses, surgical guides, and other custom elements.
- Email and messaging services. Support our communications with you.
- Technology infrastructure and website providers.
Third parties acting as independent controllers:
- The radiology center, when your specialist prescribes an imaging exam.
- The external professionals or centers to whom your specialist refers you (physicians of other specialties, physiotherapy, speech therapy, imaging, or others), with whom we share only the records necessary for the consultation. Every referral is disclosed to you and recorded in your file; if you prefer that we do not share your records, you can tell us and you will provide them yourself to the professional attending you.
- The electronic payments platform, which processes online the payments you make, under its own legal and security obligations.
- Orthodontic device manufacturers, when you undergo aligner treatment (see Section 7).
- Your insurer or supplementary insurance, when you request reimbursement documentation from us.
- Health, judicial, or administrative authorities, when the law requires us to provide information.
If Zenclinic changes ownership. In the event of a sale, merger, reorganization, or closure of the clinic, Zenclinic will adopt the legally required measures to ensure the custody, preservation, and availability of the clinical records. When they must be transferred to a new controller or an authorized custodian, we will inform you in advance, and you may request the portability of your record to the provider of your choice, to the extent compatible with the legal preservation obligations. The clinical record is only transferred to healthcare providers or legally authorized custodians, never for commercial purposes.
7. Transfer of your data outside Chile
Orthodontic treatments with aligners require sending your three-dimensional intraoral scan and the necessary clinical records to the device manufacturer, which is located outside Chile.
This transfer is essential to manufacture your aligners: without it, the treatment cannot be carried out. It is performed under contractual protection guarantees equivalent to those required by Chilean law.
Before starting an aligner treatment, you will be informed of this transfer and asked for your express authorization. If you do not authorize it, we will not be able to perform the aligner treatment, but this does not affect your access to Zenclinic’s other services in any way.
Some of our technology providers may also store information on servers located outside Chile. In all cases we require contractual protection guarantees. You may ask us at any time for updated information on the destination country, the identity or category of the recipient, and the applicable safeguards.
8. How long we keep your data
Clinical record and clinical images: at least 15 years from the last visit, in accordance with the health regulations that require us to preserve it. This period admits no exception, not even at the patient’s request.
Tax and accounting documents: for the periods required by tax law.
Administrative and scheduling communications: for as long as the relationship with the patient lasts and for the time needed to handle any complaints.
Data processed with your consent (informational communications, use of images for dissemination): until you revoke your consent.
Once the periods have elapsed, the data is securely deleted or anonymized.
9. Your rights
The law grants you, free of charge, the following rights over your personal data, which you exercise in the terms and with the exceptions established by law:
- Access: to know what data we process and obtain a copy.
- Rectification: to correct inaccurate or outdated data.
- Erasure: to delete it when there is no longer a basis for keeping it.
- Objection: to object to a specific processing, including reminders and informational communications.
- Portability: to receive your data or have us transmit it to another provider.
- Blocking: to temporarily suspend processing while a request is resolved.
- Revoke your consent, for processing based on it, without affecting what has already been done.
How to exercise them
Write to contacto@zenclinic.cl, with a copy to admin@zenclinic.cl, stating your name, your Tax ID (RUT), and the right you wish to exercise. We will verify your identity before processing the request, to protect your information. We will acknowledge receipt within the following 2 business days and respond within the maximum number of business days permitted by law. Blocking requests are resolved within 2 business days.
One limit. The right of erasure does not extend to your clinical record while the legal preservation period is in force: the law requires us to keep it, and that obligation also protects you.
If we reject your request, respond partially, or fail to respond within the deadline, you may complain to the Personal Data Protection Agency.
10. Use of clinical images
Your photographs, X-rays, and scans are part of your clinical record and are used to diagnose and treat you. That use is part of your care.
Publishing them is a different matter and requires your explicit permission. Using your images on social media, on our website, in advertising, or for teaching purposes requires a specific, separate, written authorization, which:
- Is voluntary. Refusing it does not affect your care, your treatment, or your price.
- Details the channels where the image will be published, for how long, and whether it will appear in an identifiable form or not.
- Is revocable at any time, without explaining why, by writing to contacto@zenclinic.cl, with a copy to admin@zenclinic.cl. We will remove the image from the channels we directly control. Copies that third parties have downloaded or replicated are beyond our control, and we honestly warn you of this.
Zenclinic never publicly confirms that a person is its patient, nor reveals treatments that the patient has not made public.
11. Websites and cookies
Our websites (zenclinic.cl and invisalignchile.cl) use cookies and similar technologies. We group them into three categories:
Strictly necessary. They allow the site to work: security, stability, and memory of your own consent preferences. They do not require your authorization, because without them the site does not operate.
Analytics. Used to generate metrics on how our pages are browsed and thus improve them. They may involve technical identifiers, as detailed in the settings panel.
Marketing. They allow us to measure the performance of our campaigns and show you more relevant content.
Your consent. When you first enter, you will see a cookie settings panel. Analytics and marketing cookies are not activated until you accept them: until then, the corresponding scripts remain blocked and do not collect any of your data. You can accept all, reject all, or choose by category. Rejecting is as simple as accepting.
You can change your mind whenever you want. The settings panel remains permanently accessible from the site’s footer. From there you can revoke your consent at any time, with the same effort with which you gave it. You can also delete already-installed cookies from your browser settings.
The detail of each cookie. The complete and up-to-date list of the cookies we use, with their name, provider, purpose, and duration, is available in the cookie settings panel of each site. We keep it there, and not in this document, so that it always reflects the site’s actual state and not an outdated snapshot.
12. Minors
We process minors’ data only in the context of their dental care and with the authorization of their parent or legal representative, who signs the health declaration and the informed consent.
We never publish images of minors without the written, specific, and separate authorization of their legal representative.
13. Information security
Professional secrecy. Every Zenclinic professional is subject to professional secrecy, a legal and ethical obligation that exists independently of this policy and whose breach has legal consequences. The clinical record is, moreover, a confidential instrument by mandate of Law No. 20,584.
Platform with ISO 27001 standard. Your clinical record and schedule are managed in Dentalink, a HealthAtom platform specialized in clinics, which manages information security in accordance with the international standard ISO 27001, the reference standard in this field used by highly critical organizations such as banks, governments, and health systems. Under this standard, the platform applies security and access controls aimed at safeguarding the confidentiality, integrity, and availability of patient information, and includes periodic backups so that your clinical history is not lost in the event of a technical failure.
Confidentiality commitments. Zenclinic staff and the providers that process data on the clinic’s behalf are subject to confidentiality commitments regarding patient information.
Zenclinic periodically reviews these measures and works continuously to strengthen them.
If a security breach occurs affecting your personal data, we will notify the Personal Data Protection Agency and, when it entails a high risk to your rights, also you, without undue delay and in the cases, timeframes, and conditions required by applicable law, explaining what happened and what you can do.
14. Automated decisions
Zenclinic does not make decisions about your treatment based solely on automated systems. The digital tools we use (intraoral scanner, simulations, digital planning) are diagnostic aids. The clinical decision is always made by a professional, and you can always ask for it to be explained to you.
15. Changes to this policy
We may update this policy when our processes, our providers, or applicable law change. The version in force will always be published, with its date, at zenclinic.cl and invisalignchile.cl. If the change is substantial, we will notify you directly.
